La violencia de género especial mención al proceso penal

Abstract

El presente Trabajo de Fin de Grado pretende conocer la Violencia de Género, tras la aprobación de la ley de violencia de género, los cambios que se han producido a través de su entrada en vigor. Primeramente se explicará en qué consiste y qué la diferencia hay con la violencia doméstica. A partir de aquí, el trabajo se introducirá en las medidas que se han tomado a través de la ley, entre ellas se nombraran las que se realizaron con la aprobación y otras que se han ido llevando a cabo con el paso de los años como los cambios en el código penal o el pacto de estado en materia de violencia de género. Inevitablemente se expondrán los Juzgados de Violencia sobre la Mujer, que será núcleo del trabajo ya que se trata de un órgano especializado con el fin de resolver los conflictos en materia de violencia de género por lo que se hará explicará su competencia territorial y objetiva. A continuación se conocerá el procesamiento y los tipos que existen, de ahí se expondrán los derechos y garantías del agresor y de la víctima, las de esta última irán encaminadas a que no sufra una victimización secundaria.

The current work order degree pretends to make known the genre-based violence, after the adoption of the gender violence law, the changes that have occurred through its entry into force. First, it will be explained what it is and what the difference is with domestic violence. From here, the work will be introduced in the measures that have been taken through the law, including those that were made with the adoption and others that have been carried out over years as the changes in the penal code or the state pact regarding gender-based violence. Inevitably, the Courts of Violence against Women will be presented, which will be the core of the work since it is a specialised body with the aim of resolving conflicts in the area of gender-based violence, which will explain its territorial and objective competence. Then, it will be known the processing and the types that exist, from there the rights and guarantees of the aggressor and the victim will be exposed, those of the latter will be aimed at not suffering a secondary victimisation.
