Las medidas privativas de libertad aplicables a menores infractores

Abstract

Tras las diferentes modificaciones de la ley que trata la responsabilidad penal de las personas menores de edad, se consolida la Ley Orgánica 5/2000, de 12 de enero, reguladora de la Responsabilidad Penal del Menor. Dentro de esta ley, concretamente en el artículo 7, se encuentran desarrolladas las diferentes medidas, que no penas como en el sistema de adultos, que les son aplicables a los que tienen más de 14 años y menos de 18 cuando cometen una infracción contemplada en el Código Penal. Por lo tanto, serán castigados conforme a la LORPM por la comisión de un delito recogido en el CP de adultos. Concretamente, de entre las medidas antes referidas, del art. 7, se desarrollarán en este trabajo las medidas que suponen una privación de la libertad de aquel que las comete. Unas medidas supondrán una mayor restricción que otras, y con su aplicación lo que se pretende es reeducar y reinsertar al menor de edad, dándole siempre especial importancia al interés del menor y a evitar que cometa un hecho delictivo en el futuro.

Actually, we have a consolidate law, LORPM, which is responsible for punish people who are under 18th and over 14th years old. On the art. 7th of this law, we can find the different measures that in Spain they apply to this people when they commit a crime. These measures are different that sticks which provided for adults over 18th years old, but the action that will be consequence of the application of the measure are in the Criminal Code of adults. So they will be punished in accordance with LORPM because an action recognized in CP. Between the different measures of the art. 7th, I am going to explain those that involve deprivation of liberty for the offender. Some measures will be more restrictive than others, and their implementation is intended to reeducate and reintegrate the minor, always giving importance to preventing him from committing a criminal act in the future, instead of giving it to punishment or repression. We find significant differences in the number of minors whose have been applied any of the measures of art. 7th with regard to their gender.
