Procedimiento de mediación y/o conciliación en el derecho penal de menores

Abstract

La mediación penal es un instrumento de la Justicia Restaurativa que poco a poco se va haciendo un lugar en nuestro sistema judicial español. La mediación penal juvenil, es una medida con un gran poder educativo para los menores y que obtiene grandes resultados en la reincidencia de los mismos. La conciliación es un método de resolución alternativo de conflictos voluntario en el que se reúnen victima e infractor con un tercero imparcial, el mediador que, utilizando las técnicas apropiadas, ayuda a facilitar el dialogo entre ambas personas para conseguir llegar a un acuerdo. Además, forma parte del equipo técnico, que es el órgano auxiliar que hace posible que se pueda llevar a cabo la conciliación y, del mismo modo, son los encargados de llevar a cabo la mediación. Este sistema es muy beneficioso para la delincuencia juvenil ya que, en muchos casos, la imposición de una pena no es la mejor solución para los problemas a esta edad, y con la conciliación lo que se intenta es dialogar hasta conseguir una solución para el conflicto. Además, la conciliación trae buenos resultados en la reincidencia gracias a su gran potencial educativo y lo que se intenta obtener de este proceso es, además de una solución a los problemas, la reeducación del menor para que no vuelva a cometer ningún delito.

Criminal mediation is an instrument of restorative justice that’s gradually becoming a place in our Spanish judicial system. Juvenile criminal mediation, is a measure with a great educational power for minors that gets great results in the relapse of them. Conciliation is a method of alternative resolution of voluntary conflicts in which they meet victim and offender with an impartial third party, the mediator who, using appropriate techniques, helps to facilitate dialogue between the two people to get to an agreement. In addition, it is part of the technical team, which is the auxiliary body that makes possible that conciliation can be carried out and, in the same way, they are in charge of carrying out the mediation.This system is very beneficial for minors since, in many cases, the imposition of a penalty is not the best solution for the problems at this age, and with the conciliation what is tried is to dialogue until obtaining a solution for the conflict. In addition, conciliation brings good results in recidivism thanks to its great educational potential and what is sought from this process is, in addition to a solution to the problems, the re-education of the child so that he does not commit any crime again.
