El contrato de rabassa morta fue el instrumento jurídico más idóneo para la expansión de la vid en la Cataluña de los siglos xviii y xix. Loado por muchos contemporáneos que le atribuían la explotación de tierras hasta entonces improductivas, acabó generando una larga polémica entre las partes contratantes causada por la división de dominios que implicaba y por su duración determinada por la vida de las cepas plantadas por los rabasaires. Algunos concedentes, animados por la introducción del concepto liberal de propiedad y el crecimiento demográfico que revalorizaba la tierra, pretendieron equipararlo a una aparcería, mientras que los rabassers se consideraban enfiteutas con derechos sobre la tierra mientras las cepas continuasen vivas. Los intereses de las partes contratantes dejaron de confluir y la seguridad que el dominio útil aportaba a los cultivadores se vio seriamente amenazada. Para comprender lo que supuso la puesta en duda del carácter enfitéutico del contrato y por qué se movilizaron tan intensamente en su defensa, hay que saber qué implicaciones tenía para ellos ser rabasaires. El hecho de poder vender, hipotecar y legar el dominio útil les hacía sentirse casi «propietarios» y distinguirse de la clase inferior de los jornaleros. The rabassa morta contract was the most suitable legal instrument for the expansion of vineyards in Catalonia in the eighteenth and nineteenth centuries. Praised by many contemporaries, who saw it as a way of putting unproductive land to use, it ended up generating a long controversy between the contracting parties over the division and duration of domains, which were determined by the lifespan of the vines. With the introduction of a more liberal property concept and the revaluation of the land due to demographic growth, some land lenders tried to make the contract equivalent to sharecropping. However, the rabasaires considered themselves emphyteutic leaseholders with rights over the land so long as the vines remained alive. The diverging interests of the contracting parties seriously threatened the security that useful domain provided for the cultivators. To understand the implications of questioning the emphyteutic nature of the contract and why they mobilized so intensely to defend it, we must know what it meant to be rabasaires. Being able to sell, mortgage and bequeath the useful domain made them feel almost like “owners” and distinguished them from the lower class of day labourers. The rabassa morta gave them an identity and a place in the agrarian social structure, which they would not easily give up. [-]
