La violencia filio-parental en los Juzgados de menores

Abstract

Dado el destacable número de casos de violencia filio-parental en España, es necesario atajar este problema social mediante la intervención en el menor logrando su reeducación y evitando la reincidencia. Para ello es preciso conocer las variables que influyen en la comisión de la violencia en el ámbito familiar y los principales factores de riesgo que la precipitan. De la misma manera es importante comprender el alcance y qué es lo que se entiende por “violencia filio-parental” ya que no todas las agresiones de hijos a padres se consideran como tal y además hay que hacer especial énfasis en el Código Penal. De esta manera el trabajo expuesto se estructura en diversas partes. Una parte general en la que se introduce el concepto de violencia filio-parental y se aportan estadísticas de la Fiscalía del Estado analizando la evolución de este maltrato, características, variables familiares, sociales e individuales. También se explica el ciclo de la violencia filio-parental, su posible relación con la violencia de género así como teorías explicativas de este tipo de maltrato hasta llegar a un ámbito más específico, la violencia filio-parental en los Juzgados en el que se analiza una muestra del Juzgado de Menores de Castellón, y para finalizar, se exponen unas breves conclusiones de la investigación realizada.

Given the remarkable number of cases of child to parent-violence in Spain, it is necessary to catch this social problem by means of the intervention in the minor achieving its reeducation and avoiding the recidivism. For it is necessary to know the variables that influence the commission of the violence in the familiar area and the main factors of risk that precipitate it. Of the same way is important to understand the scope and what is understood as a “child to parent-violence” since not all the aggressions of children to parents are considered to be as such and also it is necessary to do special emphasis on the Penal Code. This way the exposed work is structured in diverse parts. A general part in which the child to parent- violence concept is introduced and there are contributed statistics of the District Attorney's Office of the State analyzing the evolution of this maltreatment, characteristics, familiar, social and individual variables. Also the cycle of the child to parent-violence is explained, its possible relation with the violence of genre as well as explanatory theories of this type of maltreatment up to coming to a more specific area, the child to parent-violence in the Courts in the one that is analyzed a sample of the Minors' Court of Castellón, and to finish, there are exhibited a few brief conclusions of the realized investigation.
