Delitos contra el honor en las redes sociales

Abstract

In the present work I am going to treat the crimes against the honor on social networks. As we have seen in recent years, the use of the Internet has increased and with it have emerged the social networks. These types of networks allow keep ourselves informed at all time, com municate with each other instantly and facilitate to contact with people with similar interests. Jointly with this move of the society to a dimension without personal contact between people , had made a transfer of the crimes to this “on line” world. I will highlight the crimes against the honor, injury and calumny y we will see that there are different responsible of this type of crimes , f rom the users of this networks, to the proprietaries o f the service providers. In terms of civil responsibilities of thi s crimes, exist a civil responsibility derived of the crime and security measures to protect the victim of this attacks. To summarize I will point about a few real cases that have been particular relevance on our country, with this cases I will show that t his crimes were found constantly and sometimes we can’t distinguish of other messages.

En el siguiente trabajo voy a tratar el delito contra el honor en el ámbito de las redes sociales. Como hemos podido observar en los últimos años, el uso de internet ha aumentado y con él han surgido las redes sociales. Este tipo de redes permite, aparte de mantenernos informados en todo momento, una comunicación prácticamente instantánea y cierta facilidad para contactar con personas que tienen gustos parecidos a los nuestros. Ju nto a e ste traslado de la sociedad a una dimensión en la que no es necesario el contacto personal para relacionarse, ha hecho que los delitos también se trasladen a este mundo “on line”. Destacaré los delitos contra el honor, la injuria y la calumnia, y ve remos que existen diferentes tipos de responsables de este tipo de delitos, partiendo desde los usuarios de estas redes, hasta los propios prestadores de servicios. En cuanto a la responsabilidad, a parte de la responsabilidad penal de los delitos, existe una responsabilidad civil derivada de estos y unas medidas de seguridad encaminadas a proteger a la víctima de estos atentados. Por último incidiré en una serie de casos reales que han tenido cierta relevancia a nivel nacional para hacer ver que este tipo de delitos nos los encontramos constantemente y a veces ni los distinguimos.
