Las bandas latinas y la mafia China. Diferencias y grado de implantación en España.

Abstract

La criminalidad organizada es un complejo fenómeno de actualidad que abarca muy diversas manifestaciones. Sin embargo, el presente trabajo está centrado en dos de estas manifestaciones, con una gran influencia en España: las bandas latinas y las bandas de la mafia china, denominadas tríadas. Ambas organizaciones criminales tienen su origen en la discriminación social y la escasez de recursos y oportunidades a la que están expuestas determinadas minorías de la población. Estas dos modalidades de criminalidad organizada, pese a tener diversos aspectos en común, como el empleo de ritos de iniciación, de simbología propia y de normativa interna, se diferencian en otros muchos aspectos. De hecho, las bandas latinas son pandillas callejeras de origen latinoamericano que, por tanto, desarrollan su actividad delictiva en la calle. Por su parte, las redes de la mafia china actúan en España con mayor discreción y los miembros de las mismas están altamente camuflados y protegidos por la propia organización. Por otro lado, y partiendo ya no del ámbito criminológico, sino del ámbito penal, es importante destacar la completa reestructuración de los tipos penales relativos a las organizaciones y grupos criminales que ha supuesto la reforma introducida por la Ley orgánica 5/2010 en el Código Penal. Aunque dicha reforma ha solucionado el problema que suscitaba la inexistencia de un concepto penal de organización criminal, se han derivado de la misma nuevos problemas técnicos por el solapamiento que existe actualmente de los nuevos tipos penales introducidos (arts. 570 bis y 570 ter concretamente) con otras modalidades delictivas que continúan vigentes, especialmente con el artículo 515 CP. Con todo esto, el objetivo principal del presente trabajo es ofrecer posibles soluciones extrapenales con el objeto de prevenir tanto la creación de nuevas bandas latinas o redes de la mafia china, como la erradicación de las ya existentes.

The organized criminality is a complex and current phenomenon that includes many diverse manifestations. However, the present project is focused on two of these manifestations, which have a big influence on Spain: the Hispanic-America gangs and the gangs of the Chinese mafia, which are called triads. Both criminal organizations have their origin in the social discrimination and the scarcity of resources and opportunities to which certain minorities of the population are exposed. These two modalities of organized delinquency, despite of having several aspects in common, as the initiation ceremonies that they use, their own symbology and the internal regulation, they differ in many other aspects. In fact, the Hispanic gangs are street gangs, therefore, they develop their criminal activity in the street. Whereas, the groups of the Chinese mafia act in Spain with more discretion. In this sense, the members of the same ones are highly camouflaged and protected by these organizations. On the other hand, and analyzing this phenomenon from the penal sphere, it is important to highlight the reform introduced in the Penal Code by the Organic Law 5/2010, which has supposed the total reorganisation of the penal precepts relative to the criminal organizations and groups. Although the above mentioned reform has solved the problem of the absence of a penal concept of criminal organization, it has generated new technical problems because of current overlap of the new penal precepts (concretely the article 570 bis and the article 570 ter) with other criminal forms that continue into effect, especially with the article 515 of the Penal Code. All in all, the main aim of the present research is offering different possible extrapenal solutions to prevent the creation of new Latin or Chinese gangs, and to eradicate the already existing ones.
