La posición jurídica del menor víctima en el Estatuto de la Víctima

Abstract

El trabajo trata sobre en el estudio del Estatuto de la Víctima desde una perspectiva de la posición de menor como víctima del delito. Primeramente se desarrolla los conceptos básicos y relevantes del trabajo, como son el menor y la victima. La parte principal residirá en el análisis del Estatuto de la Víctima y en la exposición de los diversos artículos que realizan una especial mención cuando la víctima sea menor. Asimismo, investigaremos las particularidades que se adoptan cuando la posición del menor sea la víctima o el menor como testigo, y brevemente expondremos la posición del menor como infractor y su procedimiento. A lo largo del trabajo también se investigaran otras legislaciones que regulen la especial vulnerabilidad del menor o la posición de la víctima como es la LO 5/2000 entre otras. Por último, desarrollaremos el marco legislativo internacional que ha influenciado en el ordenamiento jurídico español en materia de menores como son las Naciones Unidas, el Consejo de Europa y la Unión Europea. Además de realizar un derecho comparado con otros países de influencia para España como es el sistema norte americano, el sistema alemán y el sistema italiano.

The work consists of the study of the Statute of the Victim from a perspective of the minor's position as victim of the crime. First of all develops the basic and relevant concepts of the work, since they are the minor and the victim. The principal part will reside in the analysis of the Statute of the Victim and in the exhibition of the diverse articles that make a special mention when the victim is minor. Also, we will investigate the particularities that are adopted when the position of the minor is the victim or the minor as witness, and briefly report we will expose the position of the minor as offender and his process. Along the work also there were investigated other legislations that regulate the special vulnerability of the minor or the position of the victim like it is her 5/2000 between others. Finally, we will develop the legislative international frame that it has influenced in the juridical Spanish classification as for minors since they are the United Nations, the Council of Europe and the European Union. Besides realizing a right compared with other countries of influence for Spain since it is the North American system, the German system and the Italian system.
