El presente trabajo intenta poner de manifiesto la evidente discriminación tributaria
a la que se ven sometidos en materia sucesoria tanto entre residentes Españoles,
como con los no residentes en España cuando se encuentran en una situación
comparablea la de los residentes. La desigualdad de trato se caracteriza por la
imposibilidad de beneficiarse de las reducciones y bonificaciones que las
Comunidad Autónomas establecen para sus residentes, perjudicando a los
residentes de otras Comunidades, como a los no residentes en España, a los
cuales se les aplicaría la normativa estatal, más gravosa. Siendo contrario al
principio de igualdad y no discriminación, tanto a nivel estatal, como en el derecho
comunitario. [-]

Spanish residents are subject on succession, as non-residents in Spain when they

This paper attempts to highlight the blatant discrimination in taxes in which the
Spanish residents are subject on succession, as non-residents in Spain when they
are in a comparable situation to that of residents. Unequal treatment is
characterized by the inability to benefit from reductions and bonuses región,
established for its residents, harming residents of other communities, and nonresidents
in Spain, to which are applied the more burdensome state regulations. It
is contrary to the principle of equality and non-discrimination, both at the state level
and in Community law. [-]
