Bullying is a form of school harassment not defined in our legal system which is rooted in the school environment, and that presents a variety of difficulties in respect of its definition and its treatment. The first issue concerns the variety of behaviours that this phenomenon includes. The second problem is related with the lack of information, which makes really difficult to determine the scope of this form of harassment. Furthermore, as we are talking about minors, the actions should be carried out in a cautiously and sensitive way in order not to damage their development as well as their educational training. Thus, it is considered that an appropriate environment to solve this conflict is the one where it takes place, that is to say, the educational centre. In some cases, the use of restorative justice as an extrajudicial solution is defended, so long as the circumstances specified in the legislation come together and the parties concur. With regard to the measures subject to be imposed, they should comply with an educational and social insertion purpose, giving priority to the minor´s best interest in any case.
We are facing a problem which affects the human dignity, the physical and psychological welfare, and the free development of the minor´s personality. [-]
