Apuntes sobre la Santa Sede y el Tratado de Empresas y Derechos Humanos

Abstract

Tras un Apartado introductorio, el presente trabajo lleva a cabo en el Apartado 2 una sucinta presentación general del binomio empresas y derechos humanos, en sus más relevantes términos actuales, acompañada de otra sobre diversas iniciativas en curso sobre el particular, entre las que destacan los llamados Principios Rectores y el Tratado Sobre Empresas y Derechos Humanos, en el marco de las Naciones Unidas, y otras a cargo de variadas instituciones. Por su parte, el Apartado 3 recorre, a partir de diversas intervenciones de los Pontífices ante las Naciones Unidas y otras del Papa Francisco ante instancias internacionales y por mor de concretos eventos, lo que se puede considerar doctrina de la Santa Sede con incidencia sobre el objeto de estas páginas. Doctrina que es asumida por el Nuncio S.M. Tomasi en una muy bien construida Declaración ante el Consejo de Derechos Humanos, que se analiza en el apartado 4 y recoge la postura favorable de la Santa Sede ante el referido Tratado. El presente trabajo concluye en el Apartado 5 con unas reflexiones finales en las que se celebra la citada postura, que sintoniza con la altura de los tiempos e impulsa con mucho relieve la protección internacional de los derechos humanos.

After an introductory Section, the present paper carries out along Section 2 a brief general presentation of business and human rights, in its most relevant terms nowadays, accompanied by another one on various initiatives under way on the particular subject. Among them we stand out the so called Guiding Principles together with the Treaty on Corporations and Human Rights, within the framework of the United Nations, and others by several institutions. On its part, Section 3 surveys, following the different appearances of the Popes before the United Nations and others of Pope Francis before international entities and for the sake of particular events, what it is considered the doctrine of the Holy See with a bearing on the object of the present pages. This doctrine is assumed by Archbishop S.M. Tomasi in a very well built on Declaration before the Human Rights Council, that is analysed in Section 4, and takes the favourable stance of the Holy See facing the aforementioned Treaty. The present work concludes in Section 5 with final reviews in which the above mentioned position is welcome, that it keeps abreast of the times and encourages in a most outstanding way the international protection of human rights.
