Tiempo de trabajo en el sector del transporte de mercancías por carretera. Una especial referencia a los trabajadores autónomos

Abstract

El tiempo de trabajo resulta primordial en aras a la seguridad y salud de los trabajadores inmersos en la actividad del transporte de mercancías por carretera (conductores profesionales). La existencia a estos efectos de una profusa regulación normativa (nacional y comunitaria) da buena prueba de ello, sin embargo, hasta hace bien poco los trabajadores autónomos del sector –abundantes en el mismo– se encontraban alejados de la regulación atinente a los tiempos máximos de conducción y períodos de descanso e interrupciones mínimos lo que les ponía en una situación comprometida dada la conexión de los accidentes de trabajo con el exceso de horas al volante en la carretera. En este sentido, el presente artículo incide en el factor tiempo de trabajo y en su relación con la aparición de accidentes y hace un recorrido por dicha normativa, poniendo de relieve la publicación del reciente Real Decreto 128/2013, de 22 de febrero, sobre ordenación del tiempo de trabajo para los trabajadores autónomos que realizan actividades móviles de transporte por carretera (BOE 23 de febrero de 2013), norma que para los trabajadores por cuenta propia, incluidos los trabajadores autónomos económicamente dependiente (TRADE), supone un importante avance en el reforzamiento de su seguridad y salud en la actividad.

The working time is of prime importance in order to ensure the safety and health of the workers involved in the activity of the carriage of goods by road (professional drivers). In this regard, the existence of a profuse normative regulation (both at national and community levels) greatly evidences this fact. However, it was not until recently that the –abundant- autonomous workers of the sector were found to be far from familiar with the regulation attaining the maximum driving hours, rest periods and pauses, which put them at risk, given the connection between accidents at work and an excessive amount of hours driving. In this way, the present article focuses on the time factor being related to the occurrence of accidents, and goes through the aforementioned regulation, underlining the publication of the recent Real Decreto 128/2013 from the 22nd of February 2013, on the ordination of the working hours for the autonomous workers that realize activities pertaining to the carriage of goods by road (BOE from the 23rd February 2013), a norm which, for self-employed workers including the economically dependent autonomous workers (TRADE), constitutes an important step forward towards the strengthening of their safety and health in the activity.
