Régimen y organización de la seguridad en España: la Guardia Civil y su nueva Ley 29/2014 de Régimen de Personal de la Guardia Civil

Abstract

El actual trabajo está basado en el conjunto de todas las Fuerzas y Cuerpos de Seguridad integradas en el modelo policial español, dándole una atención especial a la Guardia Civil, en la cual hablaremos de sus orígenes y desarrollo a largo de toda su historia hasta la actualidad, sus diferentes estructuras de organización a nivel orgánico, periférico y de personal, además de todas las funciones y especialidades que tienen. Más adelante expondremos los puntos más interesantes de la nueva ley de régimen de personal del Cuerpo, sus diferencias con el mismo texto del Cuerpo Nacional de Policía y cuáles son los beneficios y las desventajas de una posible unificación de las dos policías estatales. También hablaremos de la definición de seguridad según la Constitución Española, de los contenidos de la ley 2/1986 de las Fuerzas y los Cuerpos de Seguridad y sobre el resto de cuerpos policiales españoles así como sus funciones y ámbitos de actuación, dándole más hincapié a todas las modalidades de policía autonómica, tanto las propias como las unidades adscritas. En las conclusiones trataremos sobre las problemáticas que existen actualmente en lo referente a la efectividad y duplicidad de las funciones policiales, así como posibles soluciones a dicho problema y un par de opiniones para mejorar la seguridad pública del país y de la más que probable modificación de la ley 29/2014 por las diferencias entre algunos puntos con el texto del Cuerpo Nacional de Policía.

The current work is based on the set of all Forces Security integrated into the Spanish police model, giving special attention to the Civil Guard, which we'll talk about everything related to the Police Force: start talking about their origins and development throughout its history until now, their different organizational structures to structural, peripherals and personal level, in addition to all the functions and specialties they have. Later we will present the most interesting points of the new law regime Corps personnel, their differences with the same text of the National Police and what are the benefits and disadvantages of a possible unification of the two state forces. We also discuss the definition of security according to the Spanish Constitution, the contents of the law 2/86 of the Security Forces and the rest of Spanish police and their functions and spheres of action, giving more emphasis to all modes of regional police, both their own and the units attached. The conclusions will discuss the problems that currently exist with respect to the effectiveness and duplicity of police functions as well as possible solutions to the problem and a couple of opinions to improve public security in the country and more than likely modification Law 29/2014 on differences between some points with the text of CNP.
