La ejecución de la pena de prisión y la nueva pena de prisión permanente revisable

Abstract

En el presente trabajo se expone la pena de prisión y su método de ejecución tanto en el Código Penal actual como en la nueva Ley Orgánica 1/2015, de 30 de marzo, por la que se modifica la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal. Se explica la nueva pena de prisión permanente revisable y su método de ejecución haciéndose un breve repaso a la legislación penal de distintos países europeos con la finalidad de comparar estas legislaciones con la recientemente aprobada en nuestro país. Se concluye analizando si el aumento penológico que provoca la introducción de la prisión permanente revisable es necesario, así como la nueva modalidad de la libertad condicional y si realmente podemos justificar la introducción de esta nueva pena con el derecho comparado o no.

In the present academic work the sentence of imprisonment and its current execution method is exposed according to how it is established by the current Penal Code and by the new Organic Law 1/2015 of the 30th March in which the Organic Law 10/1995 from the 23rd of November was modified. The permanent but revisable sentence and its execution method is explained as well as a brief review of the different penal legislations from the different European countries with the aim of comparing these legislations with our new legislation which has been recently approved in our country. Finally, we have tried to analy sed if the increasing of the different sentences which makes the introduction of permanent but revisable imprisonment necessary as well as the new modality of probation and if we really can justify its introduction.
