La Ley 27/2011 ha modificado el régimen jurídico de los complementos por mínimos en dos aspectos básicos: por un lado, exigiendo la residencia en España para su abono y, por otro lado, limitando la cuantía máxima de los complementos por mínimos a la cuantía establecida cada año para las prestaciones no contributivas. Esta reforma supone, por un lado, la consagración definitiva de la naturaleza no contributiva de los complementos por mínimos y desde otra perspectiva, una limitación importante del principio de suficiencia de las pensiones en su nivel contributivo, con una mengua importante del efecto sustitución de las pensiones en su nivel contributivo.
