La prueba ilícita en el proceso civil

Abstract

Hablar de prueba ilícita en sentido estricto es referirse a la ineficacia de los resultados probatorios que se obtengan vulnerando derechos o libertades fundamentales conforme al art. 11,1 LOPJ -EDL 1985/8754-. Por ello, el art. 287 LEC -EDL 2000/77463- establece un procedimiento a través del cual las partes, o incluso el tribunal de oficio, puedan cuestionar la admisibilidad de una fuente o medio de prueba que se considere obtenido vulnerando un derecho fundamental.

In the strictest sense of the term, when we speak of illegal evidence we are referring to the ineffectiveness of proof that is obtained in violation of the defendant’s fundamental rights or liberties, in compliance with art. 11,1 LOPJ-EDL 1985/8754. Thus, art. 287 LEC -EDL 2000/77463- establishes a procedure by means of which the parties, or even the court ex-officio, can question the admissibility of a source or means of evidence that is considered to have been collected in breach of a fundamental right.
