La protección del medio ambiente se encomienda constitucionalmente a diferentes entes territoriales como son el Estado, las Comunidades Autónomas y los Entes Locales. Partiendo de lo anterior, resulta preciso destacar que los Entes Locales tienen reconocidas un conjunto de competencias respecto del medioambiente, cuya atribución y ejercicio en modo alguno se ha de estimar como una mera posibilidad; por el contrario, es una obligación que encuentra amparo constitucional tanto con el artículo 45.2 Constitución española (en adelante, CE) como con la propia Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local (en adelante, LBRL), tal como se expondrá en los distintos apartados de este trabajo. Por tanto, se impone al legislador ordinario la obligación en favor de las entidades Locales de crear las condiciones, de crear los medios y las formas para asegurar la protección del medioambiente, obligación que ha sido reiteradamente proclamada por la jurisprudencia del Tribunal Supremo, que cuenta con algunos pronunciamientos de especial interés. Junto a las competencias propias de los Entes Locales en la protección del medioambiente, pueden estos actuar como ejecutores de la normativa estatal y autonómica. En efecto, tanto el Estado como las CC.AA ostentan legalmente funciones de policía, de fomento, de prestación de servicios así como de coordinación general, planificación y sanción. La legislación actual de régimen local permite la delegación de competencias estatales y/o autonómicas medioambientales; sin embargo, su efectivo ejercicio por los Entes Locales encuentra en ocasiones graves dificultades por la falta de recursos humanos y técnicos para hacer frente a las competencias impuestas, teniendo en cuenta, además, los entrecruzamientos competenciales que se producen en esta materia y la deficiente cooperación y coordinación entre las administraciones implicadas. The protection of the environment is constitutionally entrusted to different territorial entities such as the State, the Autonomous Communities and the Local Authorities. Based on the above, it is necessary to emphasize that Local Entities have recognized a set of competences with respect to the environment, whose attribution and exercise in no way should be considered as a mere possibility; on the contrary, it is an obligation that finds constitutional protection both with article 45.2 of the Spanish Constitution (hereinafter, CE) and with Law 7/1985, of April 2, regulating the bases of the local regime (hereinafter, LBRL), as will be explained in the different sections of this work. Therefore, the ordinary legislator is obliged in favor of Local Entities to create the conditions to create the means and forms to ensure the protection of the environment, an obligation that has been repeatedly proclaimed by the jurisprudence of the Supreme Court, which has some pronouncements of special interest. Together with the competences of the Local Entities in the protection of the environment, they can act as executors of the state and regional regulations. In fact, both the State and the Autonomous Communities legally hold functions of police, promotion, provision of services as well as general coordination, planning and sanction. The current legislation of local regime allows the delegation of state and/ or regional environmental competences; however, its effective exercise by local authorities sometimes encounters serious difficulties due to the lack of human and technical resources to face the competences imposed, taking into account, in addition, the intersecting competences that occur in this matter and the deficient cooperation and coordination between the administrations involved.
