El estudio realizado se centra en el ámbito de la víctima de violencia
de género y, concretamente, esa víctima como única prueba de cargo así como
el estudio de la reciente jurisprudencia del Tribunal Supremo sobre la
declaración de la víctima en su Sentencia núm. 119/2019, de 6 de marzo. Para
que la víctima pueda ser tenida en cuenta como única prueba de cargo, se
prevén una serie de requisitos acompañados de unos criterios los cuales han
sido establecidos por el Tribunal Supremo.
Por otro lado, se hace un estudio sobre la evolución jurisprudencial del
artículo 416 de la Ley de Enjuiciamiento Criminal, con los distintos
pronunciamientos del Tribunal Supremo. El citado artículo, establece el
derecho a los familiares o allegados del acusado, poder acogerse a la dispensa
de declarar, para así, no tener que verse en la tesitura de declarar en contra de
un familiar ni tener que incurrir en falso testimonio. [-]

This study focuses on the victim of gender-based violence and
specifically on the victim as the only evidence for the prosecution, as well as on
the study of the recent jurisprudence of the Supreme Court on the victim‘s
statement in its judgement 119/2019, of 6 March. In order for the victim to be
considered as the sole evidence against him, there are a number of
requirements and criteria which have been established by the Supreme Court.
In addition, a study is being made of the case-law development of article
416 of the of the Spanish Criminal Procedural Law, with the various rulings of
the Supreme Court. The aforementioned article establishes the right of family or
close relatives of the accused to be exempted from testifying, so that they do
not have to be involved in testifying against a relative to incurt false testimony. [-]
