Evolución jurisprudencial de la Acusación Popular

Abstract

Si bien la figura del acusador popular se encuentra presente en nuestro ordenamiento jurídico actual desde 1882, la regulación de esta ha resultado en la práctica incompleta y escasa. Por ello, el objetivo de este trabajo será analizar la evolución de la figura del acusador popular principalmente desde una perspectiva jurisprudencial. Indagaremos así en el origen de esta figura, las características actuales que presenta y las diversas cuestiones que han surgido en cuanto a su aplicación. Nos serviremos pues, de la extensa jurisprudencia, tanto del TS cómo del TC, emanada hasta la fecha y analizaremos las sentencias que más han influido en la aplicación práctica de la acusación popular.

Although the figure of the popular accuser has been present in our current legal system since 1882, its regulation has been incomplete and scarce in practice. Therefore, the objective of this work will be to analyze the evolution of the figure of the popular accuser mainly from a jurisprudential perspective. We will inquire into the origin of this figure, the current characteristics that it presents and the various questions that have arisen regarding its application. We will therefore, use the extensive jurisprudence, both from the TS and from the TC, issued to date and we will analyze the sentences that have most influenced the practical application of the popular accusation.
