La jurisdicción de menores como paradigma de la justicia restaurativa

Abstract

El presente trabajo trata de explicar el papel de los menores en la justicia restaurativa haciendo mención al papel del equipo técnico, una figura muy importante para los menores delincuentes. En primer lugar, el objetivo del estudio es el ámbito de menores desde diferentes puntos de vista de la normativa jurídica. Se realiza una breve explicación de la normativa internacional, nacional y la normativa autonómica en materia de menores. Se trata de explicar la diferente legislación existen y observar que trato tienen los menores delincuentes. En segundo lugar, es adentrar el estudio en el significado de la justicia restaurativa y la comparación con la justicia actual, es decir, la justicia retributiva. Además, enfocar la justicia restaurativa desde la normativa de la Ley de Responsabilidad Penal del Menor. Por último, se mencionara el equipo técnico haciendo referencia a la entrevista realizada, así como, la recopilación de datos sobre los menores infractores.

The following work tries to explain the role of the minors within restorative justice mentioning the technical team’s role, a key figure when dealing with underage delinquents. Firstly, the object of study is the scope put on minors from a variety of points of view contained in the legal regulations. A brief explanation of the international, national and autonomic regulation of the matter surrounding minors. The goal is to explain the various legislations that exist and observe how they deal with criminal offenders when they are minors. Secondly, a different goal is to push the study into what restorative justice means and a comparison with the current justice, meaning retributive justice, as well as focusing the restorative justice from the outlook of the regulation within the Law of Minors’ Criminal Responsibility. Lastly, there will be a mention to the technical team, making reference to the interview made, as well to the data gathered concerning underage criminal offenders.
