En el presente trabajo se plantea la posibilidad de declarar el carácter necesario de un concurso de acreedores tras la tramitación y fracaso de un acuerdo extrajudicial de pagos. La cuestión adquiere importancia ante la calificación que, como crédito privilegiado, reserva la ley concursal para parte del crédito del acreedor que promueve tal concurso y ello, en relación a la necesidad de atender todo el crédito privilegiado para la obtención de la exoneración del pasivo insatisfecho, tanto se opte por la vía automática del número 4 del apartado 3 del artículo 178 bis de la ley concursal, como si se hace al amparo de la vía del plan de pagos establecida en el número 5 del mencionado apartado del ya citado precepto. In the present work, the possibility of declaring the necessary character of a bankruptcy proceeding after the processing and failure of an out-of-court payment agreement is proposed. The issue becomes important in view of the qualification that, as a privileged credit, reserves the bankruptcy law for part of the credit of the creditor that promotes such competition, and this in relation to the need to meet all the privileged credit to obtain the exemption of the passive dissatisfied, both opt for the automatic way of number 4 of section 3 of article 178 bis of the insolvency law, as if it is done under the payment plan established in number 5 of said section of the aforementioned precept.
