In this Judgement the Court deals, on one hand, with the relationshipbetween jurisdictions, and on the other hand, whether the police identity checks, carriedout in areas near internal borders, are in keeping with Schengen Borders Code. The Courtproceeds to point out, in a casuistry way, the elements which permit to distinguish aborder control over a police check and prevents this last one from having an equivalenteffect. The Court specifies the cases in which admits controls limiting the discretion ofthe States and, with that, it widens the scope of the freedom of movement [-]

En la presente sentencia el Tribunal de Justicia aborda por una parte las relaciones entre jurisdicciones, y por otra si los controles policiales de identidad efectuados en zonas próximas a las fronteras interiores son acordes con el Código de Fronteras Schengen. El Tribunal procede a señalar los elementos que permiten distinguir, casuísticamente, una inspección fronteriza de un control policial y evita que éste tenga un efecto equivalente. El Tribunal concreta los casos en los que admite controles limitando la discrecionalidad de los Estados, y con ello, amplia el alcance de la libre circulación [-]
