Riesgo de reincidencia y evolución, a través del Inventario IGI-J en una población de menores infractores

Abstract

La evaluación del riesgo de reincidencia juvenil permite comprender los factores de riesgo específicos que impulsan al menor a la comisión de actos delictivos. La mayoría de estos menores tendrán una relación puntual con el sistema judicial y solo un pequeño porcentaje persistirá en este tipo de conductas. Sin embargo, parece que la sociedad percibe a estos menores como de alto riesgo y con altos niveles de reincidencia. Por ello, con la premisa de dilucidar esta cuestión, el objetivo de este trabajo sería el de explorar el riesgo de reincidencia general, así como las áreas con mayor riesgo, realizando un seguimiento prospectivo de la evolución del nivel de riesgo de los menores infractores reincidentes. Los participantes de esta investigación fueron los menores con expediente judicial en el Juzgado de Menores de Castellón (N= 210), a los que se aplicó el Inventario de evaluación del riesgo de reincidencia (IGI-J), a lo largo de los distintos periodos de tiempo del seguimiento de 2 años. Los resultados mostraron un perfil mayoritario de menores con un nivel de riesgo bajo y un contacto puntual con el sistema judicial, rebatiendo por tanto la creencia de la peligrosidad general de los menores infractores. Por el contrario, los menores reincidentes con largas trayectorias delictivas, sí se caracterizan por un alto riesgo que iría aumentando a lo largo del periodo de seguimiento.

Risk assessment in juvenile recidivism allows understanding the specific factors that drives the juvenile to the commission of offences. Most of these juveniles will have a punctual relation with the justice system and only a small percentage will persist in this type of conducts. However, it seems that society perceives these juveniles as high risk offenders with high rates of recidivism. Hence, with the aim to clarify this topic, the objective of this paper is to explore the general risk of recidivism and the areas with higher risk, examining the risk of recidivism in a follow up period. Participants in this research were juveniles with a criminal record in the Juvenile Court of Castellón (N = 210). The Youth Level of Service/Case Management Inventory (YLS/CMI) was administered to the juveniles along the follow up period of two years. Results show a majoritary profile of low risk juveniles, and a punctual relation with justice, rejecting the belief of dangerousness on juvenile offenders. On the contrary, juvenile recidivists with long criminal trajectories are in fact characterized by a high risk that would increase throughout the follow up period.
