En la Comunidad Valenciana, la Ley 5/2011, de Relaciones Familiares de los hijos e hijas cuyos
progenitores no conviven, prioriza la custodia compartida ya que contempla el derecho de los
hijos a mantener relaciones y contacto regular con ambos progenitores. En el presente estudio,
se analizan y comparan dos informes sobre la valoración de la custodia del Equipo Técnico del
Juzgado de Familia de Castellón, más concretamente las recomendaciones realizadas por el
profesional.
Con este trabajo se pretende explorar los indicadores favorables/desfavorables y de riesgo para
la asignación de la custodia compartida o exclusiva de los menores, que cumplen las dos
familias. También se ha realizado una comparación de la exploración psicológica del progenitor
y de la progenitora por separado y de la valoración del estado de los menores. Finalmente, se ha
observado el tipo de procedimiento judicial y las técnicas empleadas por el psicólogo del
Equipo Técnico y se ha analizado el número de criterios y palabras utilizadas para elaborar las
conclusiones del informe pericial. Por ende, el análisis se ha basado en comprobar si existen
diferencias en lo anterior en función del tipo de custodia (compartida o exclusiva). Con este
estudio, se concluye que para proponer la custodia compartida no es preciso que todo sean
indicadores favorables si no que se ha de realizar una valoración y análisis de la familia en
profundidad para recomendar un tipo u otro de custodia. Debido a la Ley 5/2011 de la
Comunidad Valenciana, el alto conflicto interparental del caso 1 no hace inviable la custodia
compartida si no que hay que valorar el resto de indicadores con mayor exhaustividad. [-]

In the Comunidad Valenciana, the Law 5/2011 of Family Relations of the children whose
parents don’t live together, it prioritizes joint custody because includes the right of children to
maintain relationships and regular contact with both parents. In the present study, we analyze
and compare two reports on the assessment of the custody of the Technical Team Psycholegal
of the Family Court of Castellon, specifically the recommendations made by the professional.
This work aims to explore the favorable / unfavorable and risk indicators for the allocation of
joint or exclusive custody of minors that meet the two families. Also, it made a comparison of
the psychological exploration of the father and the mother separately and assessment of the state
of minors. Finally, there has been the kind of judicial process and the techniques used by
psychologist Technical Team and analyzed criteria and the number of words used to prepare the
conclusions of the expert report. Therefore, the analysis was based on checking whether there
are differences in the above depending on the type of custody (joint or exclusive). With this study, we conclude that to propose joint custody is not necessary that all indicators are favorable
but it has to make an assessment and analysis of the family in depth to recommend one type or
another of custody. Because to the Law 5/2011 of the Comunidad Valenciana, the high conflict
between parents of case 1, doesn't do unfeasible joint custody if not that you have to evaluate
other indicators in profoundness. [-]
