El presente estudio está enfocado al ámbito de la violencia de género. El problema
de este tipo de violencia es que se comete en el ámbito privado, es decir, en la
intimidad y sin testigos y es por ello, que la declaración de la víctima contra su agresor
es una prueba de cargo esencial para desvirtuar la presunción de inocencia. Por ello,
si la víctima se acoge a su derecho a no declarar en contra de su pareja (art.416
LeCrim) el procedimiento incoado genera un sobreseimiento provisional o se dicta una
sentencia absolutoria, por falta de pruebas contra su agresor. Con la finalidad de
comprobar esta incidencia se ha realizado un análisis doctrinal y jurisprudencialmente
y además, dándole al este estudio un enfoque práctico, realizando una estadística en
el Juzgado de Violencia sobre la Mujer de Castellón de la Plana, extrayendo los
resultados y realizando posibles propuestas de mejora para finalizar con esta
problemática muy relevante en la actualidad. [-]

This study is focused on the sphere of gender violence. The problem with this type
of violence is that it occurs in private, that is, in intimate spaces and without witnesses,
wherefore the testimony of the victim against the aggressor is key proof to challenge
the presumption of innocence. Therefore, if the victim avails herself of her right not to
testify against her partner (article 416 Criminal Law) the proceedings generate a
provisional dismissal or an acquittal is issued due to lack of evidence against the
accused. In order to test this argument, doctrinal and jurisprudential analyses have
been done, giving this study a practical approach by examining statistics in the Court
for Violence against Women of Castellon de la Plana, drawing conclusions and making
proposals for improvement of ways to end this very relevant question today. [-]
