El bullying como delito entre menores

Abstract

El bullying es una forma de acoso escolar no tipificada en nuestro ordenamiento jurídico que se encuentra arraigada en el sistema educativo, y que presenta una variedad de dificultades en cuanto a su definición y su trato. La primera cuestión es la relativa a la amplitud de conductas que abarca este fenómeno. La segunda problemática está relacionada con la ausencia de datos, lo que dificulta en gran medida determinar el alcance de esta forma de acoso. Por otra parte, al tratarse de menores de edad, se debe actuar de una forma cauta y sensible en aras de no perjudicar su proceso evolutivo, así como su formación educativa. Por ello, se considera que el ámbito idóneo para su resolución es aquel en el que se ha generado el conflicto, es decir, el propio centro educativo. En ciertos casos se defiende el uso de la justicia restaurativa como solución extrajudicial, siempre que concurran las circunstancias especificadas en la legislación, y que las partes estén conformes. Respecto a las medidas susceptibles de ser impuestas, se aboga por una finalidad de carácter educativo y de inserción social, debiendo primar en todo caso el interés superior del menor. Nos encontramos ante un problema que pone en juego la dignidad humana, la integridad física y moral, y el libre desarrollo de la personalidad de los menores.

Bullying is a form of school harassment not defined in our legal system which is rooted in the school environment, and that presents a variety of difficulties in respect of its definition and its treatment. The first issue concerns the variety of behaviours that this phenomenon includes. The second problem is related with the lack of information, which makes really difficult to determine the scope of this form of harassment. Furthermore, as we are talking about minors, the actions should be carried out in a cautiously and sensitive way in order not to damage their development as well as their educational training. Thus, it is considered that an appropriate environment to solve this conflict is the one where it takes place, that is to say, the educational centre. In some cases, the use of restorative justice as an extrajudicial solution is defended, so long as the circumstances specified in the legislation come together and the parties concur. With regard to the measures subject to be imposed, they should comply with an educational and social insertion purpose, giving priority to the minor´s best interest in any case. We are facing a problem which affects the human dignity, the physical and psychological welfare, and the free development of the minor´s personality.
