Desde el fin de los tiempos medievales hasta entrado el siglo XIX la conflictividad rural, manifestada a menudo a través de los litigios ventilados en diversas instancias judiciales, presenta una tipología tan amplia que resulta difícit de abordar. En este trabajo, el autor, una vez valoradas las aportaciones al VII Congreso de Historia Agraria de Baeza organizado por el SEHA (VI, 1995), analiza el diferente contenido social de los pleitos, dependiente del "cuerpo del delito", pero también del territorio en que surgen; destaca la efectividad de formas opacas y cotidianas de resistencia, en especial en países de policultívo, asi como la funcíón, verdaderamente capital, de los grandes tribunales en la canalización de los conflictos entre las comunidades rurales y la vieja aristocracia por prestaciones de naturaleza señorial, lo que revela la importante función del derecho en las sociedades de Antiguo Régimen. Por fin, analiza los factores que condicionan la conflictividad, en especial los de orden político (por ejemplo, la confianza en los tribunales reales), la desigual fortaleza de la comunidad campesina, las características del régimen señorial y las propias transformaciones de la sociedad rural, que daban origen a la formación de "bloques antiseñoriales" más heterogéneos de lo que pudiera pensarse. Since the end of the middleages till the beginning of the nineteenth century, rural conflict, often shown by litigations solved in Court, presents a complexity which is difficult to deal with. Taking into account the VII Agrarian History Congress organized by SEHA in Baeza, in June 1995, the author analyses the social content of these litigations, together with the territory where they occurred. The author also emphasised the effectivity of obscures and common ways of resistance, particularly in policultivation countries, as well as the important part of high juries when dealing with conflicts between rural communities and the old aristocracy, relating to manor obligatory services, which reveals the importance of law in Ancient Regime societies. Finally, he analyses the factors that caused such conflictivity, which particular attention to those of political order (e. g. reliance on Real Courts), the unbalanced strength of peasant community, the characteristics of feudal regime and the transformations of rural society, which generated the formation of more heterogeneous “antifeudal blocks” than it could have ever been thought.
