La Unión Europea ha perseguido desde sus inicios la consecución de un mercado interior en el que las cuatro libertades comunitarias están garantizadas. Pero Europa no es sólo una unión económica, es también un espacio cultural. A pesar de la inicial insensibilidad del proyecto europeo hacia la cultura y las limitaciones que supone ostentar una mera competencia de apoyo o complemento en este ámbito, las instituciones europeas protegen la multiculturalidad que conforma la identidad europea. El artículo 36 del TFUE ampara que la libre circulación de mercancías pueda ser restringida por razones de índole cultural: la protección del patrimonio artístico, histórico o arqueológico nacional y de la propiedad intelectual. Los mandatos del mercado interior ceden frente a la preservación del patrimonio cultural europeo, la protección de la diversidad cultural y el refuerzo de la identidad cultural europea, como presupuesto para avanzar hacia una integración más humanista y la materialización de un espacio común en el que la cultura se beneficia de los mandatos del mercado interior, al tiempo que se defiende la especificidad de los bienes y servicios culturales. From the beginning, The European Union has been pursuing the consecution of an internal market in which the four communitarian freedoms are guaranteed. However, Europe does not only mean an economic union, but also a cultural space. Although the indifference of the European project towards culture and the restrictions that involves having simply a mere supporting or supplementary competence in this area, the European institutions protect the multiculturalism that defines European identity. Article 36 of the TFEU enshrines the possibility of limiting free movement of goods due to cultural reasons: protection of cultural heritage and intellectual property. Requirements of internal market give up in favour of the preservation of European cultural heritage, the protection of cultural diversity and the reinforcement of European cultural identity, since that is necessary for advancing towards a more humanist integration and the materialization of a common space, where culture can take advantage on the benefits of internal market, meanwhile the specificity of cultural goods and services is defended.
