En el presente trabajo de investigación vamos a hablar sobre la justicia restaurativa la cual tiene su manifestación más importante en la mediación. Se entiende como un sistema alternativo y extrajudicial de resolución de conflictos en el cual el protagonismo lo poseen las partes enfrentadas. La justicia restaurativa no sustituye la justicia tradicional únicamente la complementa para ofrecer a los ciudadanos una mayor calidad y diversidad para la resolución de conflictos.
El procedimiento de mediación recae sobre unos principios de obligatorio cumplimiento para que el mismo no pueda vulnerar algunos de los derechos fundamentales contemplados en la Constitución como tal.
La introducción de la mediación, como sistema de resolución de conflictos será complementaria y extrajudicial asi como necesaria e inminente. Esta será aplicable primordialmente a delitos de menor gravedad. Ante la ausencia de normativa regulatoria el legislador tendrá que confeccionar una normativa estatal que regule todo lo que concierne a la misma, como el momento procesal idóneo para someterse a la mediación.
Así pues, la mediación tiene por objetivos, la reparación del daño de la víctima como la rehabilitación del delincuente. También una de sus finalidades es agilizar la vía jurisdiccional para la mayor efectividad de la misma. [-]

In this research we will talk about restorative justice which has its most important manifestation in mediation. It is understood as an alternative, extrajudicial dispute resolution system in which the role possess the warring parties. Restorative justice does not replace traditional justice only compliments for to provide citizens with a higher quality and diversity to conflict resolution.
The mediation procedures have mandatory principles so that it can not violate some of the fundamental rights enshrined in the Constitution as such.
The introductions of mediation as conflicts resolution system are complementary and extrajudicial, necessary and imminent. This shall apply primarily to lees serious offenses. There due to the absence of regulation the legislator will have to make a state law regulating everything related, as well as the procedural moment suitable to undergo mediation.
Thus, mediation has the following objectives, repairing the damage to the victim and offender rehabilitation. Also one of its aims is to streamline the judicial process for greater effectiveness of it. [-]
