La pena tiene tres fines principales: retribución, intimidación y resocialización; siendo éste último fin el objeto de estudio de la presente investigación. El principio de resocialización se encuentra consagrado en el artículo 25.2 de la Constitución Española al establecer “que las penas privativas de libertad y las medidas de seguridad estarán orientadas hacia la reeducación y reinserción social y no podrán consistir en trabajos forzados”. Para conseguir este mandato constitucional, el sistema penal y penitenciario ha desarrollado una serie de mecanismos dirigidos hacia la rehabilitación del reo, entre los que destacan: la suspensión y sustitución de la pena privativa de libertad, los beneficios penitenciarios, las relaciones con el exterior, el tratamiento penitenciario y la libertad condicional. Sin embargo, las últimas tendencias político-criminales están dirigiendo nuestro sistema penal hacia un sistema más punitivo que resocializador, ya que han tendido a introducir nuevos tipos penales, han agravado los ya existentes y han provocado un mayor abuso de la pena de prisión. Pero lo cierto es que ésta tendencia del Derecho Penal de endurecer y aumentar el cumplimiento de la pena de prisión, no ayuda ni a reeducar al interno ni a detener o frenar la delincuencia, sino que principalmente lo que consigue es paliar las fuertes alarmas sociales, generadas en gran parte por los medios de comunicación. All sentences have three main aims: retribution, intimidation and re-socialization; being the last aim the study object of this essay. The principle of re-socialization is gathered in article 25.2 of our Spanish Constitution which establishes: “Custodial sentences and safety measures will be directed toward social re-education and rehabilitation and will not be able to consist in forced labor”. As a consequence of this precept, criminal and penitentiary system has developed various mechanisms in order to achieve the offender‟s rehabilitation, such as: suspension and substitution of custodial sentences, prison benefits, relations with outside world, penitentiary treatment and probation. However, the last criminal policy tendencies are directing our criminal system towards a system more punitive, leaving aside the resocializing spirit; due to they have introduced new criminal behaviors, have toughened the criminal offenses and have caused a major abuse of prison sentence. Nevertheless, this current tendency of Criminal Law, characterized for hardening and increasing the enforcement of prison sentence, does not help to the offender‟s rehabilitation and either reduces or stops crime rates; it just satisfies the strong social alarms, which are generated, in great measure, for the media.
