El derecho de los abuelos a relacionarse con los nietos. Visión psicosocial y jurídica.

Abstract

In the present work has tried to justify on the one hand the decision of the legislator in the laws in force that protect the relationships of grandparents with grandchildren and at the same time if this decision is influenced by the importance given to the role of grandfather within society. In jurisprudence, there are several laws at national and international level that protect the rights of children and that increasingly focus on regulating the right of grandparents to interact with grandchildren. Specifically, Article 160 of the Civil Code reflects the recognition in the Legal Order of the communication and contact relations between grandparents and grandchildren. In the social sphere great importance is attached to the figure and role of grandfather, describing them as highly relevant figures within the family. En el presente trabajo se ha tratado de justificar por un lado la decisión del legislador en las leyes vigentes que amparan las relaciones de los abuelos con los nietos y al mismo tiempo si esta decisión está influenciada por la importancia que se le concede al rol del abuelo dentro de la sociedad. En la jurisprudencia existen diversas leyes a nivel nacional e internacional que amparan los derechos de los niños y que se centran cada vez más en regular el derecho de los abuelos a relacionarse con los nietos. Concretamente, en el Artículo 160 del Código Civil se recoge el reconocimiento en el Ordenamiento Jurídico de las relaciones de comunicación y contacto entre abuelos y nietos. Dentro del análisis jurídico hemos prestado especial atención a la justa causa y al interés superior del menor. En el ámbito social se le otorga gran importancia a la figura y rol del abuelo, describiéndolos como figuras de gran relevancia dentro de la familia.
