La mediación penal de menores, instrumento de la justicia restaurativa, cada vez tiene más peso en nuestro proceso penal, pues se observa que a través de su aplicación se obtienen resultados óptimos. Pero para que ello sea posible necesita dotarse de un grupo de personas formadas en ese ámbito, como por ejemplo el mediador, el psicólogo, etc., asimismo tiene que respetar los principios tanto de la justicia restaurativa como de los propios de la mediación, además de observar lo más adecuado para el interés superior del menor infractor y también de las necesidades de la víctima.
La utilización de esta vía está generalizándose porque aporta a la víctima una sensación de justicia y al menor las herramientas necesarias para poder relacionarse correctamente con las personas y aprender a solucionar sin violencia los conflictos que puedan surgir en su día a día, además de desarrollar empatía y así entender el dolor causado a su víctima.
Para poder ser parte de un programa de mediación se hace indispensable que se siga un proceso, legalmente establecido, para que sea válida la solución a la que se llega. Por ello, el primer paso a tener en cuenta es observar en qué supuestos es aplicable la mediación y, consecuentemente, cuando iniciarse, en cuyo caso se podrá empezar en la fase de investigación únicamente para los delitos menos graves y leves y en la fase de ejecución de la medida para cualquier tipo de delito.
