El derecho de los abuelos a relacionarse con los nietos: comparativa del ámbito psicosocial y jurídico

Abstract

El derecho de los abuelos a relacionarse con los nietos es, como su propio nombre indica, el reconocimiento que el Ordenamiento Jurídico en el artículo 160 del Código Civil, otorga a los abuelos para mantener un contacto y una comunicación con sus nietos. En el presente trabajo se ha tratado por un lado de justificar dicha decisión del legislador, y por otro si esta decisión viene influenciada por el papel que la sociedad otorga a la figura del abuelo. Para ello ha sido necesario hacer una revisión de distintos artículos, investigaciones y estudios tanto de la rama jurídica como psicosocial para comprobar la importancia que unos y otros otorgan a los abuelos. Una vez analizados los distintos ámbitos, la conclusión general a la que podemos llegar es que tanto el ámbito psicosocial como el jurídico reconocen la trascendencia que los abuelos tienen en la vida de los nietos, creándose entre ellos una relación especial que no se crea con ningún otro familiar, siendo ésta la razón fundamental por la que a los abuelos se les dota de más relevancia tanto social como jurídica.

The grandparent’s right to relate with their grandchildren is, as it states, the acknowledgment that the Legal System in the article 160 of the Civil Code grants the grandparents the preservation of the contact and communication with their grandchildren. This work, on the one hand, comes to justify such decision of the legislator and, in the other hand, to certify if this decision is influenced by the role that society assigns to the image of the grandparents. To be able to do so, a revision of distinct articles, investigations and studies was required, both in the juridical and in the psychosocial aspects, to demonstrate the importance that both of them assign to the grandparents. Once analyzed the different aspects, the general conclusion we can achieve is that, the juridical and the psychosocial aspects recognize the transcendence that grandparents have in the life of their grandchildren, which creates a special bonding between them that is not created with any other family member, being this the fundamental reason why grandparents are granted more relevance, either social and juridical.
