Régimen y organización de la seguridad : la Guardia Civil

Abstract

Analizamos la historia de la Guardia Civil desde sus antecedentes históricos hasta la época actual, pasando por su evolución histórica y su adaptación a las necesidades de cada momento. Observando su historia desde sus inicios, podemos ver los objetivos y principios con los que nacieron y entender así las consiguientes modificaciones hasta la época actual. Su historia forma parte de la historia de España, y de los grandes sacrificios que han tenido que hacer hasta llegar a la situación actual. Posteriormente analizamos los puntos más característicos de la Guardia Civil, y las nuevas modificaciones introducidas por la Ley de Régimen de Personal de la Guardia Civil. Esta nueva legislación ha sido un avance reclamado por las asociaciones más numerosas dentro del Cuerpo, sin embargo, aún existen diferencias importantes con el resto de Fuerzas y Cuerpos de Seguridad. Entre las características más diferenciadoras de la Guardia Civil con respecto a otras Fuerzas y Cuerpos de Seguridad destacan el Régimen miliar del Cuerpo, y las consecuencias que ello conlleva –en su gran mayoría representan una merma de derechos para todos sus integrantes-, analizamos todas estas diferencias y las comparamos con otras Fuerzas y Cuerpos de Seguridad. Por último, contemplamos la posibilidad de la unificación de las dos Fuerzas y Cuerpos de Seguridad de ámbito nacional –Cuerpo Nacional de Policía y Guardia Civil- en un solo Cuerpo y todas sus consecuencias. En conjunto la unificación de los dos Cuerpos tendría más ventajas que inconvenientes, suponiendo un gran ahorro para la administración y una mejor coordinación dentro del Cuerpo, dando como resultado una mayor eficacia para el interés general. También analizamos el resto de Fuerzas y Cuerpos de Seguridad, la historia de todos ellos y las funciones que desempeñan.

The history of the different police groups that currently exist in Spain is analysed, observing how each of them has evolved as well as the unifications performed over time. Observing their history since the beginning, the initial objectives and fundaments can be recognized, understanding the subsequent modifications until current days. Regarding the Cuerpo de la Guardia Civil, its history is part of Spain history and this group has been adapted according to the needs of the State. Later, the key points of the Guardia Civil are analysed as well as the new modifications introduced by the Personal Regime Law of the Guardia Civil. This new legislation has been an advance produced by the largest associations within the group. However, there are still important differences with the rest of Fuerzas y Cuerpos de Seguridad. The military regime of the group and the corresponding consequences –the majority of them represent a reduction of the members rights- stand out among these differences. All of these differences are analysed and compared with other Fuerzas y Cuerpos de Seguridad. Finally, the possibility of a unification of the two national Fuerzas y Cuerpos de Seguridad –namely, Cuerpo Nacional de Policía and Guardia Civil- into one unique group is addressed, including the corresponding consequences. These unification would have positive and negative aspects, implying large savings for the administration and a better coordination within the group, resulting more efficient and effective for the good of the State.
