El menor infractor: reincidencia posterior al internamiento en un centro de menores

Abstract

En este trabajo se van a analizar los estudios realizados sobre la delincuencia juvenil y sobre la reincidencia de los menores infractores para averiguar el nivel de reincidencia que hay posterior al cumplimiento de una medida de internamiento. Para realizar este trabajo es necesario determinar los factores de riesgo que incentivan la aparición de la conducta delictiva en menores. También es preciso analizar el panorama legislativo actual que regula la situación de los menores infractores exponiendo la evolución histórica que ha habido hasta llegar a la vigente LO 5/2000. Se han de explicar las medidas que se les pueden imponer a los menores infractores que en la LO 5/2000 se exponen, para comprender mejor el funcionamiento de la situación penal del menor. Con los resultados de las investigaciones analizadas se pueden establecer una serie de conclusiones, ante las cuales se intentan aportar posibles soluciones, a la delincuencia de menores y a la reincidencia de dicha delincuencia

: In this article there are going to be analyzed some of the studios made about the juvenile delinquency and about the recidivism of the young offenders to find 6 out the real level of recidivism there is before the internment. To get this, is necessary to determine the risk factors that encourage the apparition of the minor criminal behavior and more specifically about the causes that encourage the recidivism. This requires analyzing the current regulatory landscape governing the situation of young offenders by exposing the historical evolution that has been up to the current LO 5/2000. There is also necessary to explain the measures that are imposed on young offenders which are exposed in the LO 5/2000, to understand better the functioning of the criminal background of the minor criminals. With the results of the research there may be established a set of conclusions, to which are exposed some possible solutions to the young offenders and to the recidivism.
