El transporte suborbital de personas: la regulación en los Estados Unidos y la hoja de ruta en la Unión Europea

Los vuelos privados suborbitales comenzaron a llamar la atención en 2004, cuando la compañía estadounidense Scaled Composite LLC ganó el Ansari X-Prize al completar su nave SpaceShipOne dos vuelos a una altitud superior a los 100 kilómetros en dos semanas. En la actualidad son cada vez más frecuentes. Durante los mismos, se asciende hasta las capas altas de la atmósfera sin alcanzar la velocidad de inyección en órbita ni la velocidad de escape, para posteriormente bajar a Tierra en caída libre, lo que permite observar su curvatura y tener una experiencia en gravedad cero de unos pocos minutos. España no dispone todavía de una regulación del transporte espacial, aunque uno de los objetivos anunciados por el actual Ministerio de Ciencia e Innovación consiste en la definición de un Plan Nacional del Espacio y la promulgación de una ley del espacio. Por otra parte, en marzo de 2023 la Agencia Europea de Seguridad Aérea ha publicado un estudio realizado por encargo de la Comisión Europea, en el que analiza las acciones preparatorias necesarias para establecer un futuro marco regulador de las operaciones en el espacio aéreo superior, incluido el transporte suborbital de personas. En este contexto, el presente trabajo, tras analizar el concepto de transporte suborbital, estudia el modelo regulatorio estadounidense, por tratarse de la primera y más avanzada regulación de la materia, así como la aproximación de la Unión Europea a este fenómeno.; Private suborbital flights began to attract attention in 2004, when the U.S. company Scaled Composite LLC won the Ansari X-Prize by completing two flights at an altitude of more than 100 kilometers in two weeks with its SpaceShipOne spacecraft. Currently, they are becoming more and more frequent. During these flights, one ascends to the upper layers of the atmosphere without reaching the speed of injection into orbit or the speed of escape, and then descends to Earth in free fall, which allows observing its curvature and having an experience in zero gravity of a few minutes. Spain does not yet have a space transportation regulation in place, although one of the announced objectives of the current Ministry of Science and Innovation is the definition of a National Space Plan and the enactment of a space law. On the other hand, in March 2023 the European Aviation Safety Agency published a study mandated by the European Commission, in which it analyzes the preparatory actions necessary to undertake a future regulatory framework for operations in upper airspace, including suborbital human flights. In this context, this paper, after analyzing the concept of suborbital transport, studies the US regulatory model, as it is the first and most advanced regulation of the matter, as well as the European Union’s approach to this phenomenon.

En el presente trabajo estudiaremos el cambio de tendencia operado por la sentencia de la Gran Sala del Tribunal Europeo de Derechos Humanos, de 24 de enero de 2017, en el caso “Paradiso y Campanelli contra Italia”, con respecto a la dictada por la Sección Segunda del mencionado Tribunal en el 2015. En dichos fallos, como veremos, la cuestión principal radica en considerar la existencia de una posible vulneración del artículo 8 del Convenio Europeo de Derechos Humanos, relativo al derecho a la vida privada y familiar, por las medidas adoptadas por las autoridades italianas con respecto al niño, que supusieron que el mismo acabase siendo arrebatado permanentemente de sus padres intencionales.; This dissertation deals with the change in trend occurred as a result of the judgment of the Grand Chamber of the European Court of Human Rights, dated 24th January 2017, in the case of “Paradiso and Campanelli versus Italy”, with regard to the previous one delivered by the Second Section of the Court in the 2015. In such judgments, as we will see, the main question lies in considering a possible infringement of the article 8 of the European Convention on Human Rights, on the right to private and family life, because of the measures taken by Italian authorities in respect of the child, which resulted in the latter’s permanent removal of the minor from his intended parents.

La Audiencia Provincial de A Coruña resolvió el 24 de mayo de 2023 un recurso de apelación interpuesto contra una sentencia que, a su vez, declaraba caducada una acción de impugna-ción de la filiación de un menor de nacionalidad venezolana y establecía una prestación alimenticia a su favor. En su sentencia, la Audiencia tras analizar los puntos de conexión que atribuyen jurisdicción y competencia a los tribunales españoles y que permiten determinar el Derecho aplicable en este tipo de supuestos, argumenta sobre la posibilidad de aplicar de oficio el Derecho extranjero pese a la falta de alegación y prueba del mismo por parte de los interesados.; On May 24, 2023, the Provincial Court of A Coruña resolved an appeal filed against a ruling that, in turn, declared an action to challenge the filiation of a minor of Venezuelan nationality to have expired, establishing a maintenance benefit in his favor. In its ruling, the Provincial Court, after analyzing the connection points that attribute jurisdiction and competence to the Spanish courts and that allow determining the applicable law in this type of cases, argues about the possibility of applying fore-ign law ex officio despite the lack of allegation and proof thereof by the interested parties.

of Valencia between the thirteenth and fifteenth centuries. It analyses the
evolution of, and relations between, the general legal system, the royal
government and administration and the main organs of power representing
the political community of the kingdom. This case, which is supported by
extraordinarily rich legislative and parliamentary sources, is an excellent
example of the political transformations that were taking place across
Europe during this period.
