Durante muchos años se han tratado de encontrar nuevas alternativas para hacer frente al
delito. Hasta hace pocos años la sociedad solamente podía acudir a la justicia tradicional penal
para ver satisfechos sus intereses, pero las respuestas que ofrecía solamente se centraban en el
castigo del culpable y en restablecer las leyes que habían sido infringidas. Es a partir del siglo XX
cuando empieza a surgir una nueva forma de hacer frente al delito, la justicia restaurativa. Por lo
tanto, como consecuencia a la búsqueda de alternativas y de actuaciones más apropiadas y útiles
para hacer frente al delito surgió la Justicia Restaurativa como una nueva forma de enfocar la
criminalidad, de atender mejor a la víctima y de responder de mejor forma al delito cometido.
Además poco a poco se ha ido extendiendo el ámbito de actuación de la justicia restaurativa, y es
que no se aplica solamente a casos de escasa gravedad, sino que es posible desarrollar servicios
de justicia restaurativa incluso en casos graves como los de terrorismo, lo que supone una nueva
concepción de justicia, basada en la humanidad y partiendo de la flexibilidad de su ámbito de
aplicación. Por lo tanto, con la justicia restaurativa se devuelve el protagonismo a todas las partes
afectadas por el delito, víctima, victimario y la comunidad.
For many years we have tried to find new ways to tackle crime. Until recent years the society
could only go to the traditional criminal justice to see satisfied their interests, but the answers
offered were focused only on punishing the guilty and restore the laws had been violated. It is the
beginning of the twentieth century when it begins to emerge a new way of dealing with crime,
restorative justice. Therefore, due to the search for alternative and more appropriate and useful
measures to tackle crime Restorative Justice emerged as a new way to approach crime, to better
serve victims and better respond to crime committed. Furthermore gradually has been extended
the scope of restorative justice, which is that not only applies to less serious cases, it is possible to
develop services restorative justice even in serious cases such as terrorism, which is a new
conception of justice, based on humanity and based on the flexibility of its scope.Therefore , with
the role of restorative justice is returned the importance to all parties affected by the crime, victim,
offender and community.
